Limited Hardware Warranty Policy for All Regions Except Australia/New Zealand

THIS LIMITED HARDWARE WARRANTY IS PROVIDED IN ADDITION TO STATUTORY WARRANTIES YOU MAY ENJOY UNDER THE APPLICABLE LAWS OF YOUR COUNTRY, STATE OR REGION.

This limited hardware warranty applies only to WD Arkeia-branded hardware (“Product”) sold by Arkeia Software, Inc., Western Digital Technologies, Inc. or their respective worldwide subsidiaries (collectively, all such entities, “WD Arkeia”), authorized resellers or authorized distributors. The term “Product” DOES NOT include any software applications or firmware, non-WD Arkeia products or non-WD Arkeia branded peripherals. WD Arkeia’s only warranty obligations with respect to software are set forth in the applicable end-user license agreement provided with such software.

Limited Hardware Warranty

WD Arkeia warrants that the Product, in the course of its normal use, will for the term defined below, be free from defects in material and workmanship and will conform to its published specification. Unless otherwise required by law, the term of your limited hardware warranty is ONE (1) YEAR from the date of original purchase by the end-user purchaser (“Warranty Period”). The term of your warranty period shall commence on the purchase date appearing on your purchase receipt from an authorized distributor or authorized reseller. Proof of purchase shall be required to be eligible for this warranty and to establish the commencement date of this warranty. Warranty service will not be provided unless the Product is returned to an authorized distributor, authorized reseller or regional WD Arkeia return center where the Product was first shipped by WD Arkeia. WD Arkeia may at its discretion make extended warranties available for purchase.

Limitations/Exclusions

WD Arkeia shall have no liability for any Product returned if WD Arkeia determines that the Product was (i) not purchased from an authorized distributor or authorized reseller, (ii) not used in accordance with WD Arkeia specifications and instructions, (iii) not used for its intended function, or (iv) stolen from WD Arkeia, or that the asserted defect a) is not present or b) is attributable to misuse, improper installation, alteration (including removing or obliterating labels and opening or removing external enclosures, including the mounting frame), accident or mishandling while in the possession of someone other than WD Arkeia.

Subject to the limitations specified above, your sole and exclusive remedy shall be, during the Warranty Period and at WD Arkeia’s option, the repair or replacement of the Product with a new or recertified product that is equivalent to or better than the Product. To the fullest extent permitted by applicable law, WD Arkeia’s entire liability for any defective product shall in no event exceed the purchase price for the defective product. Such limitation applies even if WD Arkeia cannot or does not repair or replace any defective product and your exclusive remedy fails of its essential purpose. The foregoing limited warranty of WD Arkeia shall extend to repaired or replaced Product for the balance of the applicable period of the original warranty or ninety (90) days from the date of shipment of a repaired or replaced Product, whichever is longer.

PRODUCTS ARE COMPLEX AND FRAGILE ITEMS THAT MAY OCCASSIONALY FAIL DUE TO (A) EXTERNAL CAUSES, INCLUDING WITHOUT LIMITATION, MISHANDLING, EXPOSURE TO HEAT, COLD, AND HUMIDITY, AND POWER FAILURES, OR (B) INTERNAL FAULTS. SUCH FAILURES CAN RESULT IN THE LOSS, CORRUPTION, DELETION OR ALTERATION OF DATA. WD ARKEIA SHALL HAVE NO LIABILITY FOR LOST DATA REGARDLESS OF THE CAUSE, RECOVERY OF LOST DATA, OR DATA CONTAINED IN ANY PRODUCT PLACED IN ITS POSSESSION.

THE FOREGOING LIMITED HARDWARE WARRANTY IS WD ARKEIA’S SOLE WARRANTY AND IS APPLICABLE ONLY TO PRODUCTS SOLD AS NEW. THE REMEDIES PROVIDED HEREIN ARE IN LIEU OF A) ANY AND ALL OTHER REMEDIES AND WARRANTIES, WHETHER EXPRESSED, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND B) ANY AND ALL OBLIGATIONS AND LIABILITIES OF WD FOR DAMAGES INCLUDING, BUT NOT LIMITED TO ACCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, OR ANY FINANCIAL LOSS, LOST PROFITS OR EXPENSES, OR LOST DATA ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE, USE, OR PERFORMANCE OF THE PRODUCT, EVEN IF WD ARKEIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME COUNTRIES, STATES, AND REGIONS DO NOT ALLOW THE EXCLUSIONS OR LIMITATIONS SET FORTH ABOVE, SO SUCH EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.

To Obtain Service

WD Arkeia values your business and always attempts to provide you the very best of service. If the Product requires maintenance, either contact the dealer from whom you originally purchased the Product or visit our product support Web site for information on how to obtain service. If it is determined that the Product may be defective, you will be given instructions for the Product’s return. An unauthorized return will be returned to you at your expense. Your original box and packaging materials should be kept for storing or shipping your WD Arkeia product.

Limited Hardware Warranty Policy for Australia/New Zealand

Nothing in this warranty modifies or excludes your legal rights under the Australian Competition and Consumer Act or the New Zealand Consumer Guarantees Act. This warranty identifies WD Arkeia’s preferred approach to resolving warranty claims which is likely to be quick and simple for all parties.

No other warranties either express or implied by law, including but not limited to those contained in the Sale of Goods Act, are made with respect to the Product. If you purchased your Product in New Zealand for the purposes of a business, you acknowledge and agree that the New Zealand Consumer Guarantees Act does not apply.

In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure. What constitutes a major failure is set out in the Australian Consumer Law.

In Australia, if the Product is not of a kind ordinarily acquired for personal, domestic or household use or consumption, provided it is fair and reasonable to do so, WD Arkeia limits its liability to replacement of the Product with a new or recertified product that is equivalent or better than the Product.

This hardware warranty shall extend to repaired or replaced Products for the balance of the applicable period of the original warranty or ninety (90) days from the date of shipment of a repaired or replaced Product, whichever is longer. This warranty is WD Arkeia’s sole manufacturer's warranty and is applicable only to Products sold as new.

The benefits provided to you under this warranty are in addition to other rights and remedies available to you under the Australian Competition and Consumer Act or the New Zealand Consumer Guarantees Act, that may not otherwise be disclaimed.
